If there is no custody, child support and parenting time order, both parents have equal rights to the child. However, if the father signed an Affidavit of Parentage, this document refers to the mother as the custodial parent. If the father signed the Affidavit of Parentage, you could deny him any time with your daughter and deny him the ability to take your daughter to Germany. Also, in order for your daughter to travel to Germany, both parents would have to sign for the passport. Your refusal to sign would limit his ability to take the child out of the United States. You should file a motion in court seeking a determination of custody, child support and parenting time. Once there is a court order, both of you would know what your respective rights were.
