QUESTION

What should I do about my sons father?

Asked on Aug 06th, 2012 on Family Law - Indiana
More details to this question:
My sons father has not seen or contacted me or my son about seeing him in over a year. I have tried to contact him roughly 4 times in this past year and can''t find him and only get to pass information on through his family to him. My sons father had supervised visitation for about 4 years (my son is 5 years old) because he can not be trusted what so ever by himself with my son. I tried to let him have unsupervised visitation about 5 different times and each time he violated the court order (or in other words the main reason he had supervised visitation in the first place, he violated it). My sons father is a drug addict and has a horrible reputation for being violent I don''t want my son around him at all since it has been over a year without any contact at all and I am not too sure what to do about it.

Honestly, if he is not pushing the issue, then you really do not have to do anything.  You could petition to modify his parenting time to be even more restricted (meaning none, unless he petition's the Court), but why expend the resources to hire an attorney to do that?  You may be wondering if you can file to terminate his rights, but that can only be done under Indiana law if there is a pending adoption or the State files to terminate his rights.  Again, if he is not pushing the issue, then there really isn't anything to do.  If he tries to pursue visitation, then you have a pretty solid case as to why you didn't allow him to see the child in the fact that you couldn't find him.
