QUESTION

What step do I take next?

Asked on Nov 27th, 2023 on Divorce - Pennsylvania
More details to this question:
My divorce attorney in pa just recently told me I am still married! I filed for divorce in January of 2022. I paid her retainer and an extra 400 dollars for the final set of divorce paperwork and was told my divorce would be finalized in 20 days from the second set of paperwork and that was the 400 dollars to finalize it. It is now November of 2023 and I contacted my same lawyer because she did my custody agreement as well and I had an emergency custody I had to end by submitting paperwork so I called her to let her know I had those documents and she informed me I’m still married as well and I need to pay 450 dollars to finish it. In a year and a half she never contacted me to tell me my divorce never was finished and she didn’t finish. I filed taxes as divorced and other things as well and this whole time had no knowledge she didn’t finalize my divorce nor did she ever contact me and I would have never known without contacting her about something else. Why do I have to pay again?

Update Your Profile
I cannot comment on the status of your retainer with counsel, but all attorneys are obligated to communicate with their clients in a prompt fashion and similarly handle matters for which they were engaged.  If you have a fee dispute with your attorney, you have several options:  1) submit a complaint to the local bar 2) submit a complaint to the PA disciplinary board  3) sue her. I trust this answers your question but do not hesitate to call or email on a free initial basis. Matthew R.
