What would i be entitled too?

More details to this question:
I am looking into the possibility of a separation from my husband while trying to meet with a counselor. Our living situation is that we live in a house my parents own, which is around the block from my parents house that they also own and reside in. Because his family is from the Rockland County area of NY, he is saying he refuses to leave and wants me to be the one to leave to go to my parents. I do not want this to affect the case that if we do take this father, that I would loose any possibility of loosing my daughter. Who we would split evenly right now, week by week if I were to move in with my parents. We've been married for 4 years this upcoming Wednesday, but I do not want to jump to things as its an emotional situation. I look forward to speaking with someone in more depth soon.
