QUESTION

Where do I start to get my son back?

Asked on Oct 03rd, 2016 on Child Custody - California
More details to this question:
When my ex and I separated. We made a plan for visitation. She stopped communicating but when she needed money, I sent it to her and told her I wanted to see my son. I was in another county (30-40min drive). After I sent the money, I started my drive where she had agreed to let me have him for the day. He was 3 and we raised him together since birth and I claimed paternity at birth. When I arrived to where she was supposed to be, nobody was there so I called her family. They said she got on a plane and flew to another state. It’s been a year. I want my son in my life.

You need to obtain court orders for custody and visitation if you don't have them. If you have court orders in California then you can take action to enforce them by both attempting to modify the court order and registering the court orders in the child's new state. If there are no custody orders at all, then you have to file a new case for custody orders in the child's new State since the child has lived there more than 6 months. You should consult with an attorney in both CA and the new State for more specific advice.
