QUESTION

Where should I file?

Asked on Dec 30th, 2013 on Divorce - Colorado
More details to this question:
My husband and I both agree to a divorce. We have no assets to divide or children. We married in Missouri but now I live in Colorado and he in Missouri. I printed out papers from completecase.com. I signed and notarized what I needed to but I am unsure now what the next step is. Do I file in CO, and if I do, does he need an absentee waiver? We are both unable to make trips out of state for court appearances. Any advice would be greatly appreciated.

You can file in the county where you live. If you file jointly as petitioner and co-petitioner, you don't need a waiver of service. If there are no children, you should be able to get though it without any court appearances, but there are some deadlines you have to meet to avoid going to court. I hope this helps.
