QUESTION

Which date should be followed for child visitation?

Asked on Feb 04th, 2014 on Child Custody - Texas
More details to this question:
Trying to determine 5th weekend visitation. We have always gone by the Fridays in the month since visitation is Friday at 6 until Sunday at 6 for the past 4 years. Now her new husband is trying to say it goes by the Saturdays. Which is it?

It should say in your order. If it doesn't, you will need to either come to a mutual agreement moving forward (and put it in writing) or go back to the court to clarify the order.

Whatever you agree to. If she now wants Saturdays does it really hurt? You could spend an arm or a leg fighting over nothing. I am not even sure how it would affect anything. If the new month starts on Saturday the parent got the kid. If the new month starts on Friday, the other parent gets the kid. I guess my point is, does it really matter?

It depends upon how the order is written. I would think it is Friday as well, especially since that is the status quo. Perhaps you can make an appointment with the Court of Conciliation or Custody Mediator (depending upon what is offered at your courthouse) and see if they can clarify for the two of you. Appeal to your ex to not let the new spouse cause acrimony.

Visitation is based on the Fridays of the month. You are probably running into a problem this month because there are five Fridays in January. Because of this there is back to back visitation the last week in January and the first week in February.

A 5th week end would mean there is a 5th Saturday and/or Sunday.

If the order is not specific as to when the parenting time starts, as long as you consistently use the same method, either Friday or Saturday, it should not make a difference.

I would have to look at the order, the actions of the past 6 years will be very relevant, and likely controlling.
