More details to this question:
Married 3 years ago right after he goes to work out of town, which I told him in the beginning. I didn't want a man that works out of town only home once or twice a month. He did anyway and haven't been together since I moved from Kansas where we married to Texas just wanted to be done with him and marriage.

After 3 years you will probably only get a divorce.

Unfortunately South Carolina does not have " no-fault" divorce as in other states. Therefore just because you and your spouse have irreconcilable differences, that does not give you grounds for a divorce. South Carolina recognizes four grounds for divorce, namely: adultery, desertion for a period of over 1 year, physical cruelty, and or habitual drunkenness. If you have lived separate and apart for over 1 year without even one night's cohabitation, both parties may file for divorce based on one years' continuous separation.
