QUESTION

Why it was easily dismissed?

Asked on May 31st, 2017 on Domestic Violence - Nevada
More details to this question:
I was a victim of domestic violence and granted an extended protection order upto a year with my 3yr old daughter Casey Mills. My husband Craig Mills recently came in his trial on May 22, 2017, he pleaded guilty to DUI but the charges for Domestic Battery was dismissed, because I'm not at the court to testify, "no show". Here is the point, I'VE NEVER SERVED AND I DID NOT RECEIVED ANY COURT ORDER to notify me to attend to my husband's trial. Now, who is responsible for giving me the notice papers? Whoever is that needs to show up, he needs to prove me wrong, or else they are guilty for not strive hard to have me the papers. So now I need to appeal to push my husband to face the charges for Domestic Battery. But I can't afford a lawyer. I don't have work or any source of income. I'm seeking for someone who can help me through this with my child. Hoping lawyers here can help me. Thank you.

You seem to have a couple of diffierent court processes confused.  As to the TPO, that is a civil process, with you on one side and your ex on the other; and you indicate that you got the order you requested. The criminal prosecution, on the other hand, is "the State" on one side, and your ex on the other.  You are the victim, and a witness, but not a party.  To answer your question, it was the prosecutor's job to give you notice and secure your attendance and testimony -- in the absence of that testimony, presumably the State could not obtain a conviction.  If you have questions about what happened and why, call the D.A. or other prosecutor and ask.
