Will DCFS always be involved?

More details to this question:
In 2007, I had my parental rights terminated and the DCFS case was closed. I have since corrected the issues leading up to a DCFS case in the first place. I am getting married (Divorced the father of the children finalized in 2009) in 5 months and we would like to eventually have a family. Will DCFS take the child into custody at the hospital? Will they even open a new case at all?

They shouldn't unless they have reason to suspect you are a danger to the child. For example, if you are on illegal drugs and the hospital tests show that, the doctor will most likely contact them and they will most likely take custody of the baby before you ever see it. There are many other reasons and circumstances in which DCFS could crawl up in your business but if you have been doing well and doing the things you are supposed to be doing there is no reason for them to bother you now.

I doubt it. You had your children taken away because of certain behaviors on your part. You say those behaviors no longer exist. DCFS will only get involved if somebody complains. Since the behaviors don't exist, no one will complain, right?

That depends on whether or not there is a reason to get involved e.g. a bad tox screen in the hospital, etc.

It is impossible to tell on the facts presented, it is not unheard of to have the DCFS reopen a case to include subsequent after-born children.

DCFS will not open a new case unless they get a report of abuse or neglect. However, If they find a need to open a new case, all of the information from the previous case will be available to them.
