More details to this question:
I have full physical custody of my daughter ,I'm her father. Her mother has visitation rights but she will not abide by the custody rights , she only picks her up when she wants to and that only on some. holidays. She goes four or five months without visiting her, when it suppose to be every other weekend. Will I be able to get full custody as well ?

Legal custody and visitation are different. legal issues  The court is only concerned about the best interest of the child.  Are you asking the court to change visitation and legal custody? Or, are you asking the court to change legal custody, without making any changes to visitation?
