My wife bought our home 9 years prior to us getting together,and marrying. Since then we have refinanced to put an addition on and she had to add my name to the mortgage and deed for financial reasons. Together now 13 years!! In 2008 we were exempted from paying property taxes due to me being awarded the Purple Heart in Iraq, in 07'. Now my wife is talking DIVORCE,and I'm only on SSDI AND VA COMP and she is hooting about Alimony like she's going to be Rich. I say sell this 7 bdrm 3 full 2 half bth house and we split it 50/50 and I'd pay whatever alimony is ordered out if my share. BUT SHE SAYS IM NOT ENTITLED TO ANY OF THE PROFIT??? So I'm really up in the AIR HERE???!?!
Your wife may not be correct. The answer depends on the unique facts of each case. Among other things, it will be important in your case to talk about how the addition was paid for, the principal balance of the mortgage at the time of the marriage, the current principal balance of the mortgage, and the source of the mortgage payments during the marriage.
