QUESTION

Will I have to pay child support and why?

Asked on May 07th, 2015 on Child Custody - Nebraska
More details to this question:
Will I be responsible to pay child support for the children of my fiance? He does not have an income because he was laid off from work but I do work. If he cannot pay it does that mean that I have to? We have some joint bank accounts together.

If these aren't your children you have no duty of support. Money in your joint accounts is presumed to be owned 50/50.

You aren't liable for support of his children except (maybe) if you've been judicially granted some custody/visitation.

With the very rarest exceptions, a person may only be ordered to pay child support for their own children, whether by birth or formal adoption. There is a possibility of a kind of nasty effort to accomplish the same thing by looking at the total household circumstances of your boyfriend. It would be good to retain an experienced family law attorney who can look into the facts in much more detail, and can advise and represent you. It's almost always worth he investment.

Stepparents do not have an obligation to pay child support for their significant other's children. Please be aware though that if he gets behind and you share property or bank accounts, those bank accounts/property/even tax returns (if you file together) may be garnished because they are partially owned by him and that may have a negative effect on you.

You have no financial obligation to pay child support for children that are not yours. That is not to say, however, that assets in joint names could not be garnished or levied if there is a support order in effect.
