Trying to come up with a seperation agreement for possible divorce. My husband owns the home that I moved into. He cannot afford the mortgage now in the seperation so he is fighting that We sell the house but we will not get anything in return for the house we would be actually paying to sell it . He has offered to buy out the other person for a reasonable depreciated amount . I have been paying into mortgage and bills for 9 years. I donโt want anything back I just want to leave, he can have it all . He had a job at the moment he purchased the home that lead him to afford all bills and mortgage but now he has a lower paying job . He is trying to ensure he isnโt stuck with the house he can no longer afford without me but when he purchased it he was paying everything alone without me being in the picture . Will I be responsible for the house ? For paying half for it even with proposing for him to keep all values I purchased ie washing machines , upgraded like new bathroom , kitchen .
Thank you for your question. As part of a divorce it will need to be determined what will occur with the home. Regardless of whose name the home is in, if it was purchase during the marriage with marital funds, it is a marital asset that will need to be divided. In some cases, one party may wish to keep the home and buy out the others interest. Generally after this occurs the party that maintains the home is responsible for the costs. In other situations, neither party may be able to afford the home and it will need to be sold with the proceeds to be split. Based on your circumstances, I would suggest contacting an experienced family law attorney to address your specific concerns.I hope this information was helpful to you.
