QUESTION

Will I still be able to get full custody?

Asked on Sep 11th, 2018 on Child Custody - New Jersey
More details to this question:
The mother of my son moved to Maryland. We legally have joint custody with a week on and a week off, this was ordered two weeks ago. Kindergarten is not mandatory in NJ and that is why the judge said she ordered this. However, after research Kindergarten is mandatory in Maryland. If his mother goes and registers him even though he will be missing every other week, would that hurt my case? Can I prevent her from doing so? We go back to court on 10/15/18. I have been his sole provider since he was born up until last year when it was ordered for us to split the week and every other weekend.

Thank you for your question. Neither party is entitled to leave the State of NJ with a child without the consent of the other party or a Court Order. It is evident that the current arrangement is going to impact the child’s schooling and this needs to be addressed as soon as possible as it affects the child’s best interest. Based on your circumstances, it would be best to contact an experienced family law attorney to address your specific concerns and to ensure you understand your rights. I hope this information was helpful to you.
