Without the child’s father does a stepmother have any rights?

More details to this question:
My husband and I have been separated since June, but his 15 year old son is living with me. My stepson's mom passed away in 2005 and he spent several years living with his grandparents before we got custody in March. He also has a younger brother who still lives with them. My husband lives in another town and has not seen his son in several weeks. They do communicate over the phone. If I file for divorce will I have any legal rights to my stepson? He will be 16 in January and he does want to live with me.

You will have no legal rights to your stepson unless (1) your husband gives you a power of attorney or (2) you file a petition to become his guardian.
