QUESTION

Can I file a lawsuit for damages?

Asked on May 02nd, 2014 on General Practice - West Virginia
More details to this question:
Last week the cable company sent out some contractors to my house because the physical cables needed to be replaced. Today I was out mowing my yard when all of a sudden the mower had started to make a weird noise. I immediately turned off the mower and inspected it. To my shock there was a 7ft+ wire about as big around as a straw that they had just thrown into my yard and now it was stuck in the blades of the riding mower. I do not yet know if the mower is ruined or not, but if it needs repaired can I file a suit for damages? I know it seems like it was my fault, but if they had not just haphazardly thrown cable into my lawn this situation would never have arisen.

Yes, you can sue for the cable company's negligence.  I think it likely that a judge or jury will find that you were each partly at fault, but you could recover something.  However, you should take a look at your contract with the cable company to see what it provides with regard to any limitations on liability.
