Asked on Mar 29th, 2018 on General Practice - Washington
More details to this question:
I am getting sued by this women that was involved in accident involving her, another man, and myself. The other man hit the lady in front of me head on. they both came at me and I was unable to avoid her spinning into my lane. I had proof of insurance however I was no longer covered. I did not receive a ticket and the police said had said told me at the time of the accident that I was collateral damage and they then impound my car. I paid the tow bill I paid all repairs on my car and I had to watch the man who hit her die and she was the only car that made impact with mine. Now she is had a law suit against dale and his estate, myself, and her insurance. Can I get anything if I counter sue??

If the woman is found to have been at fault in the accident, you can recover for the damages you suffered, including the costs of repairing your car (unless Washington has a law that an uninsured driver cannot recover any damages for an accident, which I don't know).  it is very unlikely, however, that you would be reimbursed for the espenses of the lawsuit itself, however, unless you can show tha she knew, or should have known, that her claim had no merit.
