QUESTION

Can I sue a City, Judge, DA

Asked on Jun 09th, 2016 on General Practice - Wisconsin
More details to this question:
My wife was killed by a drunk driver. She plead guilty after two years of putting our family through hell. My complaint is not with the woman who killed my wife but rather the completely botched case. So many things were wrong. After all the depression wore of I reread all the transcripts and am very upset at how messed up the case was. A main point. In the transcripts the judge repeatly says the blood acohol seams about right (.11) at the time of the accident. The accident was at 6:30pm the blood draws were at 8:50pm ( .142 ) and 9:50 (.11 ) so at 6:30 it clearly was way higher. Many so called experts have told me it was most likely .2 or higher Also many other major mistakes with the case from the DA who was later arrested for fleeing the scene after a alcohol related crash. I am just wonder if this is normal as I dont have much faith in the government as it is.

I am very sorry to hear about the tragic loss of your wife; no words can adequately convey one's sympathy to you or what you and your family have been through; unfortunately, the answer to your legal question is no; judges maintain immunity from civil lawsuits as well as governmental officials such as district attorneys  you might consider talking to a local personal injury lawyer to pursue a wrongful death case for you and if you feel strongly that the judge or district attorney did not act professionally, filing a grievance with the office of lawyer regulation and for the judge, to the judicial commission.
