QUESTION

can i sue a restaurant for bug?

Asked on May 27th, 2013 on General Practice - New Jersey
More details to this question:
i was in NYC and found a bug that i had eaten part of in my food. the manager apologized to me and said sometimes the spinach has bugs on it when it comes in, its not from their facility. it is not my fault that they dont clean the produce when they get it in. i am completely disgusted with the whole situation and would like to sue them. I have the receipt they gave me refunding my money and if its possible to pull their video footage, I'm sure we can watch me spit my food out and return it. Do you think I have a case?

I'm not sure what your damages would be.  I get it - biting into a bug is gross, but you don't win damages in a law suit for "gross".  If you bit some foreign object and damaged your tooth, the cost of repairing the tooth and the pain and suffering you enduring would be your damages.  Just biting into a bug, and realizing it, and spitting it out does not result in damages.
