QUESTION

certified letter acceptance

Asked on Apr 23rd, 2013 on General Practice - New Jersey
More details to this question:
I sent a civil summons response via regular mail and certified mail (I did not include signature required). The regular mail letter did not come back, but the certified letter came back as undeliverable. I know the address is 100% correct. Legally, how can I get the certified letter acknowledged to the person I am sending it to?

You can't force a person to sign the certified mail.  I would suggest you re-send the letter, and this time ask for a signature.  The post office will try to deliver three times, and if they cannot get a signature, it will be returned to you.  You can then do an affidavit to the court stating that you sent it regular and certified, and the regular did not get returned, but the certified was refused.  If that is not acceptable, the court will tell you and indicate that it has to be served by the Sheriff's Department.
