getting married question about name change in long island NY

More details to this question:
I am using my married last name from my first marriage never changed it after the divorce and hate my maiden name. My fiance hates his last name. we were talking about last name changes and we decided we would like to use my mother's maiden name as our married new last name?

You can use any name you want, as long as you do not do so for fraudulent purposes, i.e. in an attempt to fool creditors, to avoid outstanding warrants, or something like that.
