How can my lawyer take a retainer but not produce the services requested?

About 8 months ago I paid $800 for an attorney in NJ to handle an expungement for a marijuana possession arrest. He tells me to contact him in 5 months, after 6-7 months I call him back and he says he doesn't have an open case for me, and no information, and that this has never happened before. He asked me to reproduce my bank statement and there it was $800 paid to his Law offices. I needed the expungement by the end of this year, he wants to proceed now after the fact, and as soon as I asked for a refund he offered to do it free of charge. But I'm pissed off, I want to know if there are consequences to this type of incompetence. What can I do besides take his offer?

i would accept his offer to do the expungement 'free of charge'. i would ask that he do the petition for expungement on an expedited basis. the prosecutor will work with him under these circumstances. ed dimon, esq.
