I found a tan maggot in a container of Butter Pecan ice cream would that make a case?

Did you suffer any damages other than paying for the ice cream, such as medical bills, missing time from work due to eating the maggot, etc.?  If not, you can recover the price of the ice cream, and the ice cream company might pay you something to avoid bad publicity, but your case would not be worth much.
