Long story short. My father passed away in 2000, when I was 13. My step-mom was his only beneficiary. It was an accidental death so there was no will. She got at least $118k. None of it went to my brother and I. They were only married for a few years. We got a few pictures, his albums & cds, & some whale figurines that he collected. That is about it. I had asked her this week if I may have the family curio cabinet & dining room table as my dad wanted to keep it in the family, as does his mother. I am getting my first home soon & figured I would now have the room. Well, she agreed to give me the curio, but refuses to give me the table. Keep in mind, she was married to him for a few years & that was really all that tied her to him. They had no children together. Is there anything I can do to get that table? Take her to small claims court? I would hate for it not to stay in the family! Especially considering it was one of the few things I would have to remember him by. Any advice?
Since your dad did not have a will, when he passes, the property goes to his wife, no matter how short a time period they were married. Have your offered to buy it from her?
