QUESTION

I was gifted a car. I signed the title transfer form. Can they legally take it back?

Asked on Oct 08th, 2021 on General Practice - Texas
More details to this question:
My friend gave me a car purchased for his wife. He and his wife's names were on the original title. We all signed a title transfer for form, to transfer it into my name. It was notarized the same day. My friend told me that the final step was to file it with TX DPS. As of last night, he became upset with me and is now demanding the car back. I never got a copy of the title transfer form. He has the only copy and may have destroyed it. Do I have any options here? I have screenshots of conversations explaining that the car is mine including meetup times and address of the office where we had said form notarized. Any advice?

Once an unconditional gift is made, it cannot be rescinded.  If you can convince a court that your friend and his wife gave you the car unconditionally, the court can compel them to execute and file whatever paperwork is necessary to consummate the transfer.
