QUESTION

Paralegal is not rendering services paid for. What can I do?

Asked on Apr 08th, 2017 on General Practice - Florida
More details to this question:
My husband and I are in different states and I was about to move to yet another state. Therefore, I retained a paralegal to create and file our divorce paperwork. She is providing the service on her own, outside of the law firm she works for. I wired her money to cover the divorce fees and $150 for her services. This is a simple divorce - no children, no property. It has been two months and she still has not filed. Now she is not responding to my inquiries. There was no contract for said services; only emails, texts, and phone conversations regarding expectations. Is it wise to send a demand letter to a paralegal? What are my options to either push file and meet the agreement, or demand a refund?

This sounds like the paralegal was practicing law which is illegal. She can help you fill out a form but can't file with the court on your behalf. I'd try to get my money back and/or report her to the state attorney for the unlicensed practice of law.
