My 13 yrs old autistic son (disabled by SSA determination) was shoved down by another student in his class causing him to fracture his wrist. On top of just having nasal surgery 3 days prior to the incident. Can I file charges against the student and do I have to go through the school resource officer or can I go straight to the sheriff department? The school suspended the boy for 3 days prior to us discovering that my son's wrist was actually fractured.

You may have a case against the school but also a case against the parents of the student both based on theories of negligence if the facts support that.
