QUESTION

What can be done when a person is found to be abusing their power of attorney?

Asked on Mar 23rd, 2013 on General Practice - New York
More details to this question:
POA was granted to teo people under the pretense that they would make any and all decisions together. One of those people has been found to be writing large checks to themselves, and trying to take control of all assets. The person from whom this money is effectively being stolen is currently on hospice care, and unable to make legal decisions. Is there anything that can be done to regain and/or protect his assets?

Yes.  A guardianship proceeding.  We handle this.  It is a technical proceeding you cannot do yourself, but deals with the problem.
