More details to this question:
We recently buried my dad at Gate of Heaven Cemetery in Hawthorne, NY, in a double grave site next to my mom, who was buried there in 2004. When my family and I arrived at the grave site, there was no gravestone . When we buried my mom in 2004, there was obviously a gravestone. Now, just grass. Workers started digging in the ground and found the stone about 6-8 inches under the earth, completely covered over. The workers dug it up . Firstly I was stunned at the lack of concern for my parent's grave. Secondly I was humiliated in front of my whole family. Thirdly, my family members were shocked and extremely upset. Many were weeping at this horror. We had paid $900 for perpetual care. There was no care. Cemetery staff said the cemetery was too big for them to keep up with everything. They accused us oif not visiting the grave often enough. I want to sue for pain and suffering. Who do I turn to?

You have no such claim.  In fact, I am not even sure there was a breach of the perpetual care.
