Will I be able to get my daugthers electronic item back?

My daughters friend and mother gave her an ipod 6 years ago. The screen was broken and they were going to throw it out. They bought a new one and gave the busted one to my daughter who said she might be able to get it fixed. She paid for the repairs herself and has had it for 6 years now. The friendship is on the outs and the friend got ahold of the ipod from another child and said its hers and she is keeping it. My daughter paid for all those repairs herself, had it cleared and has all her info, pictures etc on it now. The friend can now access personal things like email and facebook and we are now trying to change passwords in a frantic mess so the girl cannot access anything. Her pictures however are gone. It is openly stated in an email that they have it. They are keeping it. They know she repaired it and basically said oh well. Is there anything we can do or is my daughter out money?

a 'gift' is a complete action. the ipod belongs to your daughter.  your daughter should explain in writing to the donor that this was a gift and that the gift must be returned to the donee. you must put the parties on notice in writing. you can then sue in 'small claims court' without an attorney. ed dimon, esq.
