Evicting a spouse

More details to this question:
I live in Ohio. My daughter, husband and I currently live in a rented apartment. My husband moved in with me in the middle of my lease from out of state; he is not on the lease at all. After several domestic violence incidents ( only one where a report is made) I want him gone from my place of residence. I intend on divorcing whenever possible. I read that I cannot file until after a year of marriage? How can I get this man out of my home? I’ve heard conflicting information - that I have to file an eviction / that only the landlord can file.

You do not need to wait a year to file for a divorce, you can file now. You can also ask the court for the exclusive use of the marital residence, your apartment, during the divorce. The court will order him to vacate and find other living conditions.   Alternatively, you could evict him, but the easier route would be to file for divorce and seek to have him ordered out by the court.
