Hi, I am working with Company "X" from 2 Yrs on H1B. Transferred H1B from "X" to "Y" Company (Premium Processing is done and after that I Joined in "Y" company) Now "Y" Company told me to RESIGN after 2 Weeks and they told they will run the PAY STUB for 30 Days. So, now I would be going to have 2 PAYSTUBS for the SAME PERIOD (Say From May 11th - June 12th) from 2 Different Companies ("X" and "Y" company). My question: a. I can go back and normally work with "X" company(As I did not inform to "X" company about the transfer or "X" company did not cancel my H1B and it is valid till 2016 Year ). b. Will there be any problem in future while applying for GC? Thanks, Santosh Email ID: santoshpalvai@gmail.com
Nothing in the law precludes an individual from having two H-1B approvals at the same time. If you did not resign from company X, you should be able to continue working for the company. As you had the H-1B approved on premium processing from company Y, I do not see that you would have any problems with the issue in the future while applying for your green card.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
