In 2003 I was arrested with possession on the 7th NY penal code 220.03, but I pled guilty to Disorderly Conduct NY penal code 240.20, sentence to 1 year conditional discharge plus 2 days of community service, now I like to apply for citizenship but afraid that my guilty plea to Disorderly conduct will make me deportable and inadmissible a POE
Your guilty plea to disorderly conduct would not make you excludable or deportable. That being said, admitting to the truth of facts supporting a charge of possession could make you inadmissible at a port of entry as the law of excludability does not require a conviction, only admission of having committed acts which constitute the essential elements of an excludable offense.
