QUESTION

Am I eligible for Naturalisation

Asked on Jul 21st, 2016 on Immigration - Texas
More details to this question:
I married a US Citizen in 1998 but we returned to our birth country in 2000. I filed for and obtained my Permanent Residence Status on 01/09/2008. My travels to and from the US subsequent to that was always less than 6 months except the period July 2013- July 2014 when my father's failing health made it impossible to leave. I moved to the US with my son permanently in November 2014 and is now settled and employed. My marriage to the citizen ended in June of 2010. I would like to know if my time out in 2013-2014 is considered a disruption of my 30 months and disqualifies me from applying for citizenship?

More specific information is needed about the dates you were out of the country during the past five years. However, assuming you were out of the United States for a year or more, you will not be able to establish continuous residence. It does matter why you remained outside the country. A stay of a tear or more is an automatic disqualification. In addition, you must have been physically present in the United States for at least 30 of the past 60 months.
