QUESTION

Am I eligible to apply for permanent residency during my pending asylum?

Asked on Nov 26th, 2014 on Immigration - Texas
More details to this question:
I have been in US under B2 visa. Later, I have applied for political asylum. I have done my finger prints and got my EAD but I haven’t gotten any interview date yet. Now I have a girl friend who is a US citizen. We both want to marry.

Yes, you can get married now. However, you want to reconsider the long term prospects of each avenue, asylum vs. spouse of a citizen. Former is permanent and already in progress, latter is conditional for two years, etc., etc. Only you can weigh the pros and cons with attorney in personal consultation.

A person who enters the USA on a B-2 and marries a USA citizen, can certainly file for a green card, even if they happened to have filed for asylum.
