Am I in trouble?

More details to this question:
I almost finished (up to the point were i had my interview) my visa in germany for the usa. I had to cancel it because of missing papers. So i travelled to the united states with ESTA and applied for my visa over there. I send out papers but never got an answere back so i decided to go back to germany so I dont get into trouble. I stayed less then 180 days unlawful in the usa. I now wanted to fly back to the usa to check on our house because my husband is currently deployed. I wanted to know if i am banned for three years or if i only lost my visa application and if i am able to fly for one week to the usa because as soon as i come back to germany i was planning on applying for my visa again. I hope you can help me.

Hello Theresa. I am not sure I follow your story all the way. Were you processing your Immigrant Visa based on your marriage to a US citizen? Did the consulate give you an option to submit the missing papers? Once you violate ESTA by overstaying, you cannot use it again. You will only be barred for 3 years if you overstayed your 90 days by another 180 days.  You can contact me with further information at: harun@kvisalaw.com
