Apply for spouse outside US

More details to this question:
I would like to apply for my spouse who lives in UK; however, he is neither a permanent resident nor a UK citizen. Would there be a problem to sponsor him while he is there? If so, should he go back to country where he was born and then I will apply for him? Also, I was married previously and at that time ex-husband was resident and I had applied for him to change his status, would this affect my current situation?

You can petition for your new spouse even if you petition for a prior spouse.  Your spouse can apply for the immigrant visa from any US consulate.  It does not have to be a consulate in his home country.
