Asked on Apr 26th, 2016 on Immigration - Indiana
More details to this question:
I came to America on a visit visa on 1st April 2015. I got pregnant July 2015 and had a baby March 5th 2016. My baby was diagnosed with sickle cell disease and I don't want to be here to take care of him but I need legal documentation to be here. Is asylum something I can file for?

You may seek asylum if you have a well-founded fear of persecution on account of your race, nationality, political opinion, religion, or membership in a particular social group. Having a child with a medical condition does not necessarily make you eligible for asylum. It may be possible to seek asylum but you need to discuss the issue in more detail with an attorney. You must file for asylum within a year of your arrival. There are exceptions to this requirement but it is best to not need to qualify for an exception.
