QUESTION

Can a DUI impact citizenship?

Asked on Jun 14th, 2011 on Immigration - New Jersey
More details to this question:
My husband got a DUI 5 years back and had his citizenship interview yesterday. The interviewer told him that he needs to check back with his supervisor and we will get an answer via mail. Does this mean he will be denied? We consulted with a lawyer who told us that we should be fine since we waited the 5 year period.

It can impact the case. It depends upon whether it was a misdemeanor/felony and also if the entire probationary period was outside of the five year period prior to filing the application.

If you waited 5 years you should be ok. But nothing is ever guaranteed with USCIS.
