Yes, of course, a person can refuse to marry someone even if they are a k-1 petitioner. If the person is not interested in getting married or has changed his/her mind, there is no way to compel him or her to marry you. If you are not to be married to that person, you will need to depart the US before your I-94 expires. If you do not, you will fall out of status and become unlawfully present. After that, there are no paths for you to legalize your status within the US through any other means.
