QUESTION

Can a US Citizen give a second Citizenship to a new Foreign-born partner?

Asked on Jan 10th, 2023 on Immigration - Florida
More details to this question:
I married the father of my child (a foreign-born) and stayed in this relationship for 10 years, but I decided to divorce after he became a US Citizen. Now I have married a new partner and I wanted to know if giving him Citizenship will be possible. I am honestly sharing my life with this new partner. Not trying to play the system, just how things happened.

Even if you gained your lawful permanent residence status to a prior marriage, you are eligible to file a new immigrant petition on behalf of your new spouse. However, an immigration officer may scrutinize the application at the interview to ensure that you were in a good faith relationship with your prevuious husband. If the officer is satisfied that everything is in order, the officer should make a favorable decision. I do suggest that you contact a lawyer to be fully informed prior to proceeding.

Yes, you can sponsor your new husband for his green card even though you divorced your previous husband whom you sponsored for his green card. Work with a lawyer to make sure your case is handled competently.
