QUESTION

Can an F1 holder apply for asylum?

Asked on Aug 19th, 2014 on Immigration - California
More details to this question:
I came to the USA by F1 visa to English school. I have applied to asylum and I took receipt number. Can I leave my school or is it better to leave my school and wait? If I have terminated or end the session of my visa, can I apply to another school again after the asylum denied in future? What do prefer, try to keep going to school but it is expensive and maybe the asylum application take a long time. I donโ€™t know the best of my case. Please help me.

You need to maintain your status at all times so that if the asylum application is not approved, you can remain in valid student status.

It is always best if you can maintain your underlying nonimmigrant status. If for any reason the asylum is denied then you would still be in status. If you must leave school then just understand that if the asylum is then denied you will need to leave.
