It would be difficult for an employer to ask an H-1B employee to reimburse for H-1B expenses upon termination. If the employer was truly concerned, it should have tried to add in a liquidated damages contract clause prior to or during the time of the employment. Whether the employer can ask or sue for damages may be another question.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
