QUESTION

Can I adjust status before my court hearing?

Asked on Jan 28th, 2015 on Immigration - New York
More details to this question:
My appeal for VAWA was sustained 3 days ago. However many things are still not clear. I am wondering if I can apply for green card now before my court hearing in this coming March 26 knowing that I am in removal process. What it will happen in the court? Can I request an earlier court date? Can I apply for travel document now before the court and is there any risk of being banned to turn back at the security even though I have the travel document? What is the next step?

If your Vawa application has been granted and you are in removal proceedings then you can file for an administrative closure of the court case and then proceed to filing an I 485 to adjust status.

You need to talk to your lawyer. If your case is in Immigration court, only Immigration court has jurisdiction over adjustment of status.
