I have been hire a US based company and my H1B is in Progress. My employer wants to know if I can apply B1 so that I can use the 6 months time that I have until my H1 Start date (oct 1st) can be utilized for Knowledge transfer and consulting in my area of expertise. Could you please guide me if this is possible as my employer is very keen to explore this option? Also can my employer request my H1B with a prior start date.
You cannot do any work while in B1 status anyway so even if you could change to that status (what is your current status anyway) you would not be able to do the work that your employer wants you to do. The earliest start date of employment for a new H-1B visa is October 1, 2013 as that is when the new year's quota for H-1B visas becomes available.
I would need to know your immigration history and if you have previously been on an H-1b visa. Most likely other than very limited visits as a business visitor this is not going to work out well.
