You can be removed from the United States at any time after you violate your nonimmigrant status. You are currently present in the United States without authorization and as such can be removed at any time. You are not entitled to removal proceedings as you waived such rights when entering the United States under the visa waiver program. There are numerous visa options available to individuals from Portugal, but once you fail to maintain status most options disappear.
