QUESTION

Can I Change My F-1 Student Visa Status?

Asked on Jul 18th, 2012 on Immigration - Florida
More details to this question:
I'm a F-1 visa holder hoping to attend classes next August, I'm already in the US and I'm just waiting for the appropriate date to arrive but, since I'm from Cuba and I know I can, I'd like to stay in the US.Thing is, I already know I should wait a year to apply for legal permanent residence but my question is: What would happen if for any reason I fail to attend college in August and I lose my student status? If that happens, is there any way for me to stay legally in the country for the year?Thank you in advance!

You have to wait for 1 year and 1 day to adjust. If you are out of status and detained before then, that is when you would declare yourself Cuban with intention to stay and if there are no other problems DHS will not keep you detained.
