Can I change visa status from Visa Waiver Program to E2 Treaty Visa

Im currently in the USA on a VWP and wish to start a business. Can I change status on this Visa? Do I have to acquire a business name/LLC before applying for the E2? Do I have to go back home to Australia to do the processing? If I'm able to change status how long is the usual processing period? Thank you.

Generally the answer is no. You should discuss your business investor visa plans with counsel here in Florida so that the application to obtain the E2 visa can be handled competently.
