QUESTION

Can I cross the Canadian border with a pending ACD?

Asked on Jan 11th, 2014 on Immigration - New York
More details to this question:
This past December, I was granted an ACD for a domestic incident. I'm planning to visit Canada soon, but my concern is that I will still technically have an open misdemeanor case. Might this affect my ability to cross the border? I do plan on speaking to an immigration attorney about this matter, but I would appreciate some other opinions - thank you so much!

Technically, you have no conviction; therefore, your open case should not concern the Immigration. At the same time, a domestic violence is a crime that renders you deportable and inadmissible to the U.S. In practical terms, if you are not a citizen of the United States, you don't want to find yourself outside the United States until all charges against you get dismissed.
